Private loan agreement between friends or family – free template (Ireland)

Put a loan between private people in writing: the amount, how and when it is repaid, any interest and what happens if payments are missed. The Consumer Credit Act rules for lenders do not usually apply when the lender is not in business. A large interest-free loan within the family can count as a gift for Capital Acquisitions Tax; check with Revenue.

Legal basis: General contract law; Statute of Limitations 1957, s. 11 (6 years to claim a simple contract debt); Capital Acquisitions Tax Consolidation Act 2003, s. 40 (free use of money) · Legal position: October 2026
